The Board Of Directors Of The Talent Irrigation District
To Withhold Water Deliveries To All Delinquent Accounts
Effective with the 2021-2022 fiscal year and remain in effect indefinitely
The purpose of this resolution is to document the policy change made by the Board of Directors that no water will be delivered to delinquent accounts who have not paid all prior and current incurred charges in full, by April 1st of each year.
The district mails the incurred annual irrigation charges by February 1st of each year. Any incurred charges remaining unpaid on April 1st are deemed delinquent and a $25.00 Late Fee will be added to all delinquent accounts which owe $50.00 or more. Interest will be charged on all delinquent accounts per ORS 545.496 at the rate of one and one-third percent per month, or fraction of a month, beginning April 30th (for April’s interest) and at the end of each month thereafter.
NOW THEREFORE, be it resolved by the Board of Directors as follows:
Pursuant to ORS 545.496 the district will withhold delivery of water from any tract of land until the incurred charges for the current year and any prior years, including interest, lien, collection costs and fees, are paid in full.
This resolution shall take effect commencing with the 2021-2022 Fiscal Year beginning on October 1, 2021 and shall remain in effect indefinitely.
